Partner / Convo Access Terms and Conditions (AU) 

Welcome to Convo Australia’s website. If you continue to browse and use this website and/or participate in Convo Access, you agree to comply with and be bound by the following Terms and Conditions of Use, which together with our Privacy Policy govern Convo Australia’s relationship with you in relation to this website and Convo Access. 

Definitions

Convo Australia, we, us means Convo Australia and its related digital communication platforms and services.

Partner means an organisation that participates in Convo Access by displaying or using Convo Access materials (including QR codes, signage, decals, stickers, posters, or digital placements).

Convo Access means Convo Australia’s access service that enables people to connect to Auslan interpreting services through Convo Australia’s digital communication platforms, including via QR codes or other approved access methods.

User means any person who uses Convo Access or interacts with Convo Australia’s platforms via Convo Access. 

1. Purpose and Permitted Use

1.1 Convo Access is designed to facilitate access to Auslan interpreting services for real-time communication.

1.2 Partners must use Convo Access materials only for their intended purpose and only in the manner provided or approved by Convo Australia.

1.3 Partners must not modify, re-create, obscure, tamper with, or misuse Convo Access materials (including QR codes), or use them to mislead Users. 

2. Partner Responsibilities

2.1 Partners are responsible for where and how Convo Access materials are displayed or made available, and must ensure placement is safe, appropriate, and consistent with any guidelines provided by Convo Australia.

2.2 Partners must ensure Convo Access materials are not displayed in a way that implies Convo Australia endorses the Partner’s products or services, unless Convo Australia has provided written approval.

2.3 Partners must not represent that Convo Australia is the provider of the Partner’s goods/services, or that Convo Australia is responsible for the Partner’s staff conduct, premises, policies, or operations. 

3. User Responsibilities

3.1 Users must use Convo Access in a respectful and appropriate manner, consistent with its intended purpose of facilitating access to Auslan interpreting services.

3.2 Users must comply with Convo Australia’s Code of Conduct, available at www.convoaustralia.com/code-of-conduct, when using Convo Access and interacting with Convo Australia’s interpreters and platforms.

3.3 Users must not misuse, interfere with, or attempt to gain unauthorised access to Convo Access or Convo Australia’s platforms.  

4. Service Availability and Limitations

4.1 Convo Australia will use reasonable efforts to make Convo Access available but does not guarantee uninterrupted access or availability.

4.2 Convo Access performance can be affected by factors outside Convo Australia’s control, including network coverage, internet connectivity, device capability, or third-party systems.

4.3 Convo Australia may update, suspend, or discontinue Convo Access (in whole or part) at any time. 

5. No Warranty

5.1 To the fullest extent permitted by law, Convo Australia makes no warranties or guarantees regarding the accuracy, timeliness, performance, completeness, or suitability of information and materials on this website or within Convo Access for any particular purpose.

5.2 Use of the website and Convo Access is at the Partner’s and User’s own risk, except to the extent liability cannot be excluded under applicable law. 

6. Privacy, Data Handling, and Interpreter Standards

6.1 No personally identifiable information (PII) is collected through Convo Access QR codes. Convo Access QR codes are used to help route Users to Convo Australia’s digital entry point for the service.

6.2 By using Convo Access, the User acknowledges that Convo Australia is an external interpreting service provider and consents to the sharing of information that is reasonably necessary to assist with the User’s enquiry and to facilitate the interpreting service. Any such information is handled in accordance with applicable privacy policies and relevant legal obligations.

6.3 Convo Australia may collect non-identifying, aggregated, and/or technical information necessary to operate, maintain, secure, and improve Convo Access (for example, service usage volumes, general device or browser signals, and operational diagnostics).

6.4 Any information collected is used only for internal operational purposes, including: providing and maintaining Convo Access; customer support and service quality; security, fraud prevention, and abuse monitoring; and internal reporting and service improvement.

6.5 Convo Australia will not use Convo Access information for unrelated purposes, and will not sell or rent information to third parties. Disclosure may occur only where required or permitted by law, or to service providers engaged to support Convo Access under appropriate confidentiality and security obligations.

6.6 Convo Australia engages interpreters who hold certification from the National Accreditation Authority for Translators and Interpreters (NAATI) and who adhere to the Australian Institute of Interpreters and Translators (AUSIT) Code of Ethics, including obligations of confidentiality and impartiality in the provision of interpreting services.

6.7 Where a Partner has its own privacy policy or notices, Users should also refer to those policies for how the Partner handles information shared during the User’s enquiry. 

 7. Partner Reporting and Communications

7.1 Convo Australia may provide Partners with high-level, aggregated service insights (for example, overall usage volumes for a location or period) where appropriate.

7.2 Convo Australia will not share any information that identifies an individual User. 

 8. Intellectual Property 

8.1 This website and Convo Access materials contain content owned by or licensed to Convo Australia, including (without limitation) design, layout, look, appearance, graphics, trademarks, and brand assets.

8.2 Partners may use Convo Access materials solely for the purpose of participating in Convo Access. All other reproduction or use is prohibited unless permitted by law or with Convo Australia’s prior written consent.

9. Links to Other Websites

9.1 This website may include links to other websites. These links are provided for convenience and do not signify endorsement.

9.2 Convo Australia has no responsibility for the content, privacy practices, or availability of linked websites 

10. Prohibited Conduct and Termination

10.1 Unauthorised use, misuse, or tampering with Convo Access materials or platforms may result in suspension or termination of Partner participation and/or User access, without compensation, and may give rise to legal action.

10.2 Convo Australia may suspend or terminate Partner participation at any time where it reasonably believes continued participation poses operational, security, reputational, or legal risk. 

 11. Governing Law 

11.1 These Terms and Conditions are governed by the laws applicable in Australia. If a dispute arises, the parties will comply with any mandatory dispute resolution processes required by law.
